1. DEFINITIONS AND TERMS

DES – is the commercial name of S.C. Des Cazane S.R.L., Romanian legal entity, with headquarters in Timișoara, str. Martin Luther, nr. 2, et. 2, 300058, Jud. Timiș.

Seller – DES

Buyer – any physical or legal person placing orders online or by telephone.

Client – natural person/legal entity accessing content through electronic or other communication means.

User – registered person/entity who completed account creation and agreed to site terms.

Account – email and password section enabling order transmission and purchase history tracking.

Site – www.despotstills.eu

Order – electronic document communicating purchase intent between buyer and seller.

Goods and services – products/services mentioned in orders for seller delivery.

Contract – distance contract between seller and buyer without simultaneous physical presence.

Content – all accessible information on the site, including emails, employee communications, product information, and data.

2. CONTRACT DOCUMENTS

2.1 By ordering, buyers accept the seller's communication methods (phone or email).

2.2 Notifications after information provision don't constitute order acceptance; notifications occur electronically or by phone.

2.3 Seller reserves the right to change order quantities with buyer notification and amount refund.

2.4 Contracts conclude upon buyer receipt of shipping notification via email/SMS.

2.5 Prices and bookings remain valid for 15 (fifteen) calendar days after registration.

2.6 Site documents and manufacturer warranties support agreements.

3. ONLINE SALES POLICY

3.1 Access is available to all customers; DES reserves rights to restrict orders/payment methods based on conduct concerns.

3.2 Seller manages received information without justification obligations.

3.3 During unusual traffic volumes, DES may require manual captcha validation.

3.4 DES publishes goods/services information and partnership promotions for limited periods.

3.5 All charges for goods and/or services on the site are expressed in EURO, PLN, HUF, CZK, BGL, RON and include VAT.

3.6 Seller isn't responsible for additional buyer costs including bank currency conversion fees.

3.7 Product descriptions (images, multimedia) don't constitute contractual obligations.

4. ASSIGNMENT AND SUBCONTRACTING

4.1 Seller may assign/subcontract third parties for order fulfillment while remaining liable for obligations.

5. INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS

5.1 Content (logos, symbols, images, text, multimedia) is DES exclusive property with all rights reserved.

5.2 Buyers cannot copy, distribute, publish, transfer, modify or otherwise alter, use, link to content without express written DES consent.

5.3 Buyers may copy/use content for personal or non-commercial purposes only.

5.4 DES grants usage rights only within specific usage agreements for defined periods.

5.5 Submitted content doesn't constitute DES contractual obligations.

6. ORDER

6.1 Customers place orders by adding items to shopping carts and completing payment.

6.2 Checkout requires buyers to confirm all data provided is accurate, complete and true.

6.3 Buyers agree seller may contact them by any available means when necessary.

6.4 Seller may cancel orders after notification without obligations in cases of: bank non-acceptance of online payment, card processor transaction invalidation, incomplete/incorrect buyer data.

6.5 Within legal withdrawal deadlines, buyers must return accompanying gifts. The seller will refund the amount within 15 (fifteen) days via original payment method or bank transfer.

6.6 Seller may defer reimbursement pending goods receipt or dispatch proof.

6.7 Unavailable items result in account refunds within 15 (fifteen) days.

7. GOODS/SERVICES WITH NO WITHDRAWAL RIGHT

7.1 Excluded from withdrawal:

• Goods with price dependent on uncontrollable financial market fluctuations
• Buyer-specified or personalized goods
• Rapidly deteriorating goods
• Sealed goods (health/hygiene reasons) opened by buyer
• Used or buyer-damaged goods

8. PRIVACY

8.1 Buyer/client information remains seller property.

8.2 No public statements/disclosures occur without prior written seller consent.

8.3 Submitted materials grant seller unrestricted access to use, reproduce, display, modify, transmit and distribute them.

8.4 Account enrollment grants explicit consent for third parties, partners of DES contact including marketing/state agencies.

9. ADVERTISING

9.1 DES newsletters via approved partners ensure confidentiality/security.

9.2 Account creation allows newsletter consent expression, modifiable anytime.

9.3 Customers unsubscribe via newsletter links or phone contact anytime.

10. BILLING - PAYMENT

10.1 Displayed prices include VAT per law.

10.2 Accepted payment methods: credit cards (VISA, MasterCard), bank transfers, cash deposits, money orders, PayPal.

10.3 Seller issues invoices via electronic account additions or email.

10.4 Buyers must update account data for proper invoice communication.

10.5 Buyers accept electronic bill format delivery.

10.6 Card data processing is done exclusively through the payment platform. DES does not seek or receive any details stored on your card.

11. DELIVERY OF GOODS

11.1 Seller delivers goods to consumer/purchaser.

11.2 Proper packaging and document transmission ensured.

11.3 Seller will make delivery of Goods and Services only in countries members of European Union.

11.4 Large parcels delivered via palletized transport systems.

11.5 Delivery times: max. 15 days where the product is available in stock, max. 30 days if the product is not available.

12. GUARANTEES

12.1 All goods sold by DES, except for goods resealed, benefit under warranty according to current legislation.

12.2 DES-sold goods include manufacturer warranty certificates; Pick-up & Return provides free pickup/delivery.

12.3 Buyers must update account data for warranty certificate access.

12.4 If the warranty certificates issued by manufacturers, goods claimed defect within the warranty period must be presented directly to the nearest service centre.

13. PROPERTY TRANSFER

13.1 Property ownership will be transferred to delivery, after payment of the Buyer in the location indicated in the Order.

14. INDEMNITY

Customers assume account confidentiality responsibility. By creating the account and/or use of content and/or placing orders, Client/User/Buyer accepts expressly and unequivocally terms and conditions of the Site.

15. REVIEW/COMMENT REGISTRATION

Users grant seller non-exclusive, perpetual, irrevocable, unlimited territorial content usage rights.

Users must: reference only product features/usage, use appropriate non-offensive language, ensure realistic accurate non-misleading information, not disclose personal data or competitor URLs, not include advertising material.

Complaint deadlines: 30 calendar days of receipt.

16. FORCE MAJEURE

16.1 Neither party liable for non-performance due to unforeseeable, unavoidable force majeure events.

16.2 If events exceed 15 days, parties may terminate contracts without damages claims.

17. PERSONAL DATA PROCESSING

Personal data processing under Law no. 677/2001 (Romanian data protection), registration number 6025/2016.

Data collection purposes: account information, order status, product evaluation, commercial/marketing activities, market research, sales/behavior monitoring.

By registering, users accept all such personal data to be stored, used and processed unlimited territorial and/or temporarily by DES.

Users retain rights: information access, data intervention, opposition, erasure (written, dated, signed to info@despotstills.eu).

DES may send newsletters; unsubscription available anytime.

Personal data shared with partners (marketing, courier, payment services) under confidentiality pledges.

Data provided to authorities under and within the law.

WITHDRAWAL POLICY

Consumers have 15 calendar days withdrawal rights from possession date without stated reason.

Refunds via original payment method exclude standard delivery costs; processed without undue delay and in any event no later than 14 calendar days.
